CONSULTATION CONFERENCE (CC) OF NORTH EAST, SOOL, SOUTHERN AND EASTERN SANAAG , SOUTHERN TOGDHER  (BUUHOODLE) AND WESTERN GALGADUD REGIONS OF SOMALIA 

GAROWE, NUGAL REGION. 

THE ESTABLISHMENT OF THE PUNTLAND STATE 

 

The Consultation Conference, a major policy undertaking in the Regions, was held in the City of Garowe, Nugal Region, from 10/3/1998 to 12/3/1998. 

The Conference brought together a wide cross-section of the  communities from the six regions numbering over 255 delegates and observer: Isimada (Traditional Community Elders), leadership of the political organizations(SSDF, USP and SNDU), members of the Legislative Assemblies, Regional Administrations, representatives of the local and international NGOs, representatives of the United Nations, intellectuals, religious leaders, women’s groups and Somali and foreign observers from within the country and overseas and members of the local news media and reporters from overseas news agencies and neighboring regions. 

The Consultation Conference debated in a sober and free environment on the following agenda: 

1.       The Establishment of the Puntland State of Somalia. 

2.    A deep analysis of  the  political situation of Somalia today and the role and position of these  Regions of Somalia towards the Peace and Reconciliation Process. 

3.    Other business. 

The Consultation Conference (CC), 

HAVING HEARD the reports and papers submitted by the political organizations on the second item of the agenda; 

HAVING HEARD the submissions of the delegates from Bari, Northern Mudugh and Nugal, Sool, Southern and Eastern Snaag, Southern Togdheer and Western Galgadud regions; 

HAVING HEARD the advices of Traditional Elders, religious leaders, women’s groups, intellectuals, business people and administrators of the six Regions; 

TAKING NOTE of the earnest and enthusiastic deliberations of all participants in the Conference Conference;

DEEPLY CONCERNED with the lack of progress in the Somali Peace and Reconciliation Process;

 CONVINCED THAT Somalia still needs some time before fair and full reconciliation  is achievable;

 REALIZING THAT the Somali political system as a  unitary and sovereign nation at the end of the Civil war will never be the same  and that the future components of the nation shall be composed of states in a federation, depending on the wishes of the regions and future negotiations; 

RECOGNIZING these  regions of Somalia  have the resources and economic potential for self-development and that it shall be  a major partner in a Federal Somali State; 

UNDERSTANDING THAT the establishment of the  Puntland State shall contribute, in a major way, to peace and reconciliation in Somalia;

 

HAS RESOLVED           

AND  

HAVING GIVEN  enough time  to the deliberations on the establishment of THE PUNTLAND STATE OF SOMALIA; 

HAS RESOLVED  

a)       The holding of a Constitutional Conference  (CC) to establish THE PUNTLAND STATE OF SOMALIA.

 b)      The venue of the Constitutional  Conference shall be the City of Garowe, Nugal Region. 

c)      Duration of the CC shall be 15 days (15-30 May, 1998).

d)      The number of delegates to the Constitutional Conference shall be 433 to be allocated in the following manner:

 

*        Bari Region                                                                             97 delegates

*        Nugal Region                                                                            56    “

*        W. Mudugh Region                                                                  56    “

*        Sool & Southern Togdheer (Buuhoodle)                                     96   “

*        Southern & Eastern Sanaag                                                        56   “

*        Western Galgadud                                                                      42  “

NB. All delegates and mebers of the PC from Dhulmahante shall be selected by their Taditional Community Elders (Isimada).

*        All delegates shall be selected from their respective regions without exception.

e)       There shall be a 28-member Preparatory Commission to be participated in the following manner:

f)       Selection of the members of the Preparatory Commission shall be assigned to the  political organizations (SSDF, USP and SNDU) and the regions. 

g)      There shall be a woman from each region’s three members of the Preparatory Commission.

 h)      Selection of the Preparatory Commission members shall be based on professionalism and competency for the duties of the Commission ( see Annex A, The duties of the Preparatory Commission and its Selection Criteria; See  Annex. B, The  system of Selection and Approval of Delegates). 

I)       On Bari Region’s claim for 5 new districts and  one region, having the approval by Somali Government Decree shall be  registered and 15 districts and two regions shall be referred to the Government of the Puntland for decision. 

 

APPEAL TO THE INTERNATIONAL COMMUNITY   

Delegates of the Consultation Conference appeal to the International Community for technical and financial assistance in the holding of the Constitutional Conference, to be held on May the 15th, 1998, where the Government of  Puntland shall be born.

 Participants of the CC, however, acknowledge and thank the International Community for their humanitarian assistance to Somalia. 

Similarly, the Conference participants thank  the Isimada, Legislative Assembly, Administration and residents of Nugal Region for their hospitality as they also thank the SSDF leadership for preparing and funding the Conference.

ANNEX 1

ATTACHMENT “A” 

THE PREPARATORY COMMISSION OF THE CONSTITUTIONAL CONFERENCE (CC)

 

1.       A Preparatory Commission shall be appointed. The Commission shall be fully autonomous and independent for its tasks and shall operate in constant consultation with the Isimada ( Traditional Community Elders), SSDF, USP, SNDU, Regional Administrations and different sections of the society. To ensure the success of the Conference, the Commission shall follow the guidelines set out in this paper and finally transfer its obligations and power to the Constitutional Conference at first session. 

2.       The Preparatory Commission shall be composed of 15 members to be broken down as follows:

 

a)       SSDF                                                                    5 members

b)      USP                                                             3      “       

c)      SNDU                                                          1      “

d)      Bari Region                             ( 2 males and 1 female) members      

e)       Nugal Region                           ( 2 males and 1 female)   “

f)       Mudugh Region                       ( 2 males and 1 female)   “

g)      Sool & Southern Togdheer      (3 males   and 1 female)  “

h)      Southern & Eastern Sanaag      ( 2 male & 1 female)       “

I)       Western Galgadud                   (2 male  & 1 female)       “ 

3.       SSDF, USP and SNDU shall select their respective members of the Commission. 

4.       The remaining  members of the Commission shall be selected by the elders (Guurti) and submitted officially by  the  respective Regional Governors. 

5.       A member of the Preparatory Commission shall satisfy the following (criteria):

a)       A candidate must be a national of these of Regions of  Somalia, known for honest and integrity. 

b)      A  candidate shall have for the tasks the competency, experience, expertise, public relations  and leadership abilities. 

c)      A candidate must be a strong supporter of unity, democracy, and development at regional and national levels and actively work for the common good.

 

THE DUTIES OF THE NECC PREPARATORY COMMISSION

 

1.       In general, the duty of the Commission is to prepare the people of the NORTH EAST, SOOL, SOUTHERN AND EASTERN SANAAG , SOUTHERN TOGDHER (BUUHOODLE)AND WESTERN GALGADUD REGIONS OF SOMALIA

for the Conference and to actually convene the Conference in the City of Garowe, Nugal Region on May the 15th, 1998. 

In particular, the  Preparatory Commission (PC) shall 

a)       Appoint Technical Committees and expert groups from among themselves,  other local resources persons and overseas to prepare the Conference technical and political documentation such as

-The charter and bill of human rights.

-The structure of self-government, public institutions, judiciary, separation of powers at federal state and national levels. 

-Social, economic and resources development

-Administration of justice, law and order. 

-Regulation of resources, generation of revenue, budgeting and financial management and monetary policy. 

-The role of SSDF, USP, SNDU and Traditional Community leaders in the Puntland State. 

b)      The PC shall have the obligation to mobilize and inform the people of the  Regions the objectives of the Conference and to solicit their public support and contributions to help the Conference  succeed.

 

c)      The PC shall  supervise the Regions in following the guidelines for selection of delegates to insure genuine democratic representation.

 

d)      The PC shall prepare Conference agenda, procedures for decision-making and  code of conduct of the Conference participants.

 

e)       The PC shall  work towards creating a suitable environment for the success of such a major conference, and shall seek funding, logistics, technical and financial assistance from the regions, local and overseas agencies.

 

2.       The PC shall, the soonest possible, prepare  the  grand total budget of the Conference and identify both local and overseas sources of this budget.

 

3.       The PC shall hand over its obligations to the Chair of the Conference after the approval of the Agenda, Conference procedures and the election of the Presidium.

ANNEX 2

 

ATTACHMENT “B”

 

THE CRITERIA FOR SELECTION AND APPROVAL OF DELEGATES

 

1.       All delegates from the Regions (393) shall come under one list in which each  page have been signed in approval by the  titled elders (Guurti) and submitted officially by the respective Regional Governors.

 

2.       Selection of delegates in the Regions must be consistent with the principles of justice, consultation and fair play.

3.       The PC shall not accept any list of delegates produced in contradiction with article  (2) of the Criteria for Selection and Approval of Delegates.   

4.       The names of all delegates should reach the PC before May 1st, 1998 at latest. 

A delegate should satisfy the following conditions: 

a)       A delegate should have  the ability, the knowledge and experience necessary for administration and art of government;

b)      A delegate should be known for honest and integrity within the society;

c)      A delegate, both male and female, should be selected on the basis of his/her active and positive involvement in the affairs of his/her community;

d)      Representatives of the Preparatory Commission shall send invitations to the delegates from the Regions.
